DISCLOSURE STATEMENT

 

In accordance with SEC Rule R-204-3 the following information from Form ADV filed with Securities and Exchange Commission is disclosed to you.  As of July 1997 in accordance with new SEC/State agreements for smaller advisors, we are now registered (licensed) with the Arizona Department of Securities instead of the SEC, but required disclosures remain the same and the same SEC Form ADV information herein provided is required.

DESCRIPTION OF SERVICES AND FEES: Investment advice through consultations either as part of a financial plan or separate investment consulting. Fees based on $100 per hour, or negotiated fixed fee (typically $500), payable upon completion of recommendations. No long term contracts. If client is dissatisfied with the services provided the client can pay whatever he/she feels that the service was worth if the objection is raised within 30 days.

TYPES OF CLIENTS SERVED: Individuals, corporations, Trusts, pension and profit sharing plans.

TYPES OF SECURITIES ON WHICH ADVICE GENERALLY GIVEN: Domestic and International equity and debt offerings including mutual funds, municipal's, government's, Investment companies, real estate investment trusts as well as other public and private securities offerings and referrals to third-party money managers.

METHOD OF SECURITY ANALYSIS: Primarily evaluation of clients economic and investment objectives matched to various investment alternatives including fundamental and technical analysis methods.

SOURCES OF INFORMATION: Prospectuses, offering memorandums, confidential broker-dealer information, SEC filings, research reports, discussions with sponsor executives, other published sources and our own due diligence investigation.

INVESTMENT STRATEGIES GENERALLY RECOMMENDED: Long-term holding of investments for maximum return, or shorter-term liquid investments to meet needs for cash reserves.

GENERAL STANDARDS OF EDUCATION AND BACKGROUND OF EMPLOYEES OF ADVISOR: None specifically required. Emphasis is on integrity and people relating skills since we can provide the technical training and experience.  No investment committee.

OTHER SERVICES PROVIDED: Financial Planning and Insurance Consulting

OTHER FINANCIAL INDUSTRY AFFILIATIONS: Related persons affiliated with Multi-Financial Securities Corp., a NASD member broker dealer for implementation of securities transactions if the client so chooses.  Client is under no obligation to use affiliated broker-dealer. Dave Hutchison, a control person also has affiliations with various insurance companies. 

OTHER SECURITIES COMPENSATION: Related persons may receive commissions as registered representa­tives of a broker-dealer upon implementation of recommendations or receive solicitation fees from third party managers. Conflict of interest is fully disclosed in Advisory Agreement.

INVESTMENT OR BROKERAGE DISCRETION: Based upon our recommendations, the client can use his or her own registered representative for security purchases.  If, however, he/she wishes to have us make purchases, it will be through Multi-Financial Securities Corp or the clearing firm of Pershing at normal or discounted commission rates.  We will not have any discretionary authority. 

REVIEW OF ACCOUNTS: Periodically at request of client. Clients will receive information on their investments in the form of memorandums and updates from the investment sponsor as well as from us as we feel needed based on our monitoring of investment recommendations.

This notice is required to be given to all clients under Title V of the Gramm-Leach-Bliley Act.  Instead of just saying we do not share information with anyone without your prior approval unless required by law, which is part of our advisory agreement, we now have to give you the following disclosure.  If you have implemented any securities transaction through Multi-Financial Securities Corp, you will get a separate notice from ING Group, which is the parent company of Multi-Financial Securities Corp.

Hutchison Investment Advisors, Inc., an independent financial planning and an Arizona Licensed Investment Advisor, is committed to safeguarding the confidential information of its clients.  We hold all personal information provided to our firm in the strictest confidence.  These records include all personal information that we collect from you in connection with any of the services provided by Hutchison Investment Advisors, Inc., and/or Dave Hutchison, CFP dba Hutchison Financial Services.

 

We have never disclosed information to nonaffiliated third parties, except as permitted by law, and do not anticipate doing so in the future.  If we were to anticipate such a change in firm policy, we would be prohibited under the law from doing so without advising you first.  As you know, we use health and financial information you provide to us to help you meet your personal financial goals while guarding against any real or perceived infringements of your rights of privacy.  Our policy with respect to personal information about you is listed below.

 

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as instructed to do so by such customers unless required by law. For example, you may give us nonpublic personal information about your health situation, which we may discuss with insurance companies related to insurance you seek to obtain. 

 

We limit employee and agent access to information only to these who have a business or professional reason for knowing, and only to nonaffiliated parties as permitted by law.  For example, federal regulations permit us to share a limited amount of information about you with a brokerage firm in order to execute securities transactions on your behalf, or so that our firm can discuss your financial situation with your accountant or lawyer.  Further certain regulatory agencies including the NASD, SEC, Arizona Securities Commission and compliance auditors of Multi-Financial Securities Corp are allowed access to your files as required by law.

 

We maintain a secure office and computer environment to ensure that your information is not placed at unreasonable risk.

 

The categories of nonpublic personal information that we collect from a client depend upon the scope of the client engagement. It will include information about your personal finances, information about your health to the extent that it is needed for the planning process, information about transactions between you and third parties, and as required by third-parties to provide you produces and services that you have requested.

 

We do not provide your personally identifiable information to mailing list vendors or solicitors for any purpose.

 

Personally identifiable information about you will be maintained during the time you are a client, and for the required time thereafter that such records are required to be maintained by federal and state securities laws, and consistent with the CFP Board of Ethics and Professional Responsibility. After this required period of record retention, all such information will be destroyed.
